Recording captures alleged assault

Police say a 3-year-old girl was sexually assualted, after a forensic investigation reportedly found physical evidence to support the allegations.

The Huntington Police Department arrested Robert Arthur Cutshall Jr., last known address 526 Mayne St., on Thursday and charged him with two Level 1 felony counts of child molesting, according to court records.

A juvenile witness, whose name was withheld for protection, said she witnessed Cutshall Jr. perform sexual acts with the child for nearly an hour, according to a probable cause affidavit.

A video recording capturing audio from the incident and a medical evaluation that showed trauma to the victim was admitted into evidence, according to police reports.

A sexual assault kit was collected for possible DNA evidence. Those results of that test was not included in the probable cause affidavit. 

Police say the incident occured on April 26 while Cutshall Jr. was at the residence before an adult came to the home around 11:50 p.m. to find the juvenile witness “upset in a way (the adult) had never seen before,” according to the affidavit.

On May 8, police contacted Cutshall to schedule an interview, but police say Cutshall told them he was hiring legal counsel and would not be speaking to police without his attorney present.

His attorney declined all interviews with law enforcement, according to the affidavit.

Cutshall Jr. has posted bond, which was set at $40,000 plus $4,000 cash, and was released from the Huntington County Jail.

His next hearing is scheduled for June 3 at 8:15 a.m. in Huntington County Circuit Court.
